第2条eprovisionsmedinesiseimplementregulations关于商品商标的规定应适用于服务商标.

(l)heisapartyoracloserelativetoapartyoragent;

(2)heisrelatedinsuchawaywithapartyoragentinsofarastherelationwouldaffectimpartiality;or

(3)hehasinterestsinanapplicationfortrademarkregistrationoran}'othertrademarkmatters.

articlel0unlessotherwiseprovidedforintheseregulations,whereanydocumentissenttothetrademarkofficeorthetrademarkreviewandadjudicationboard,thedateofreceiptshallbethedateofdeliverywhereitisdeliveredpersonally}.orthedateofpostingindicatedbythepostmarkifitissentbypost;wherethedateofpostingindicatedbythepostmarkisillegible,orthereisnopostmark,thedateofreceiptshallbethedateonwhichthetrademarkofficeorthetrademarkreviewandadjudicationboardactuallyreceivesthedocument,exceptthattheinterestedpart]'isabletopresentevidenceastotheactualdateofpostingindicatedbythepostmark.

article11anydocumentofthetrademarkofficeorthetrademarkreviewandadjudicationboardmaybeservedbypost,bypersonaldeliveryorbyothermeans.whereaninterestedpartyentrustsatrademarkagency,deliveryofthedocumenttothetrademarkagencyshallbedeemeddeliverythereoftotheinterestedparty.

article12whereanapplicationisfiledforinternationalregistration,itshallbedoneinaccordancewiththerelevantinternationaltreatiestowhichchinahasacceded.thespecificmeasuresshallbeprescribedbytheadministrativedepartmentforindustryandcommerceunderthestatecouncil.

article13inapplicationfortheregistrationofatrademark,aseparateapplicationshallbefiledinrespectofeachclassofgoodsorserviceaccordingtothepublishedclassificationofgoodsandservices.foreachapplicationforthetrademarkregistration,anapplicationfortrademarkregistrationshallbefiledwiththetrademarkoffice,accompaniedbyfivecopiesofthereproductionofthetrademark;ifcolourisclaimed,fivecopiesofthecolourreproductionofthetrademarkshallbeattached,soshallbeablackandwhitedesignofthetrademark.
